1. Management of Users’ Personal Data

FinancialScents manages Users’ Personal Data in accordance with this Privacy Policy.

FinancialScents may from time to time update this Privacy Policy at its sole and absolute discretion by publishing an updated privacy policy on the FinancialScents Platforms. If there are any important updates specific notifications may be issued on the FinancialScents Platforms. You understand and agree that if you use the FinancialScents Platforms after the date on which the Privacy Policy has changed, your use shall be deemed as acceptance of the updated Privacy Policy.

2. Purpose of Collection of Personal Data

As a general rule, FinancialScents will use Users’ Personal Data for the following six purposes:

2.1 To provide FinancialScents’s service in a safe and regulated way.
2.2 For internal reference materials that will be utilized in enhancing the quality of services provided by FinancialScents.
2.3 To enhance services provided to Users.
2.4 In order to inform Users of special services or new reference materials.
2.5 In order to contact Users as required.
2.6 In order to conduct surveys on usages patterns or usage environments.

FinancialScents collects Personal Data for the extent reasonably required for the purposes stated in this Privacy Policy. If a User does not choose to provide their Personal Data or does not accept the use of Personal Data for new FinancialScents services or features, there is a possibility that the User will not be able to use services or features that require Personal Data.

3. Collection of Personal Data

FinancialScents gathers the following types of Personal Data for the following purposes:

3.1. Registration

FinancialScents requires a User’s name and email address.

3.2. Payment details

While FinancialScents does not store payment details such as a User’s credit card or bank account details, FinancialScents utilizes third party services to process the purchase and use of paid services or to send payouts for contents sold, and Personal Data will need to be provided as required for each payment or payout service. Please refer to the respective payment vendors for their privacy policies.

3.3. Provision of services

In order to facilitate the provision of services to a User, FinancialScents may collect information such as the User’s address.

3.4. Delivery of products

In order to facilitate the delivery of products to a User, FinancialScents may collect information such as the User’s address.

3.5. Communication with FinancialScents

When a User contacts FinancialScents, FinancialScents will ask for the User’s name and email address for contact purposes. Communication with a User may be retained for a reasonable period for legal and business purposes.

3.6. Participation in FinancialScents contests

When registering for a contest held by FinancialScents, FinancialScents will require the User’s name and email address for the purpose of contacting the winners.

3.7. Registering for newsletters provided by FinancialScents

When a User subscribes for newsletters provided by FinancialScents, FinancialScents will require the User’s email or social media address.

3.8. Electronic mailers and marketing materials

FinancialScents will send updates and marketing materials in relation to events or products or services offered by Event Organisers or vendors on the FinancialScentsa Platforms that FinancialScents believes will be of interest to the user to the user’s registered email address. Users may opt out of receiving electronic mailers at any time.

3.9. Usage activity collected by cookies

Cookies make it unnecessary to reenter Personal Data by saving the information within the web browser and enables content to be provided in an efficient manner to users. FinancialScents uses cookies to enable the efficient display of Internet advertisements, to count the number of users viewing Internet advertisements, and to display content without requiring the constant re-entering of Personal Information by users. Users can choose to disable the use of cookies but a significant portion of the services and features provided by FinancialScents may become inaccessible.

4. Transfer of Personal Data to Third Parties

If necessary, FinancialScents may entrust the handling of Personal Data to third parties that it has contracts with, for example FinancialScents’s web hosting partners. If so, FinancialScents will ensure that the appropriate contractual terms are included in written agreements with the Third Party stating that the Third Party shall manage the User’s Personal Data in accordance with the PDPA. If FinancialScents transfers Personal Data outside Singapore, FinancialScents will take reasonable steps to ensure that the Personal Data receives a standard of protection comparable to the protection received under the PDPA and such transfer shall be subject to this Privacy Policy by including appropriate contractual terms.

5. Other Purposes

FinancialScents may also transfer or share Personal Data in the following circumstances:

5.1. The User has consented to the sharing or publishing of his/her Personal Data
5.2. If the sharing or publishing of Personal Data is reasonably required to provide information or services that the User has requested (including but not limited to transfer of a User’s Personal Data to an Event Organiser);
5.3. In the event FinancialScents sells subsidiaries or divisions for corporate management services (In these circumstances Personal Information will be deemed business assets and will be transferred in line with agreements made in this Privacy Policy);
5.4. If the actions of the user are in violation of FinancialScents’s T&Cs and it is necessary to use Personal Data to protect FinancialScents’s rights, assets, services, etc.;
5.5. If a formal request is made from public institutions such as a court, police etc.;
5.6. If it is necessary to publish Personal Data to protect important assets such as users’ or the public’s life, health, assets etc.;
5.7. If provision of Personal Data to financial institutions is required in order to process transactions, make payouts, etc.;
5.8. If provision of a User’s Personal Data is required under law;
5.9. Any other exceptions to the prohibition against transfer or use of Personal Data provided by the laws of Singapore.

6. Changes to or Removal of Personal Data

If a User makes a request to confirm or to correct any Personal Data, FinancialScents will address the issues appropriately in accordance with the PDPA. For avoidance of doubt, FinancialScents shall not be held liable for any inability on its part to provide services to a User who fails to ensure that his or her Personal Data submitted to FinancialScents is complete and accurate or who fails to notify FinancialScents of any relevant changes to such Personal Data.

7. Security

In order to ensure privacy and security, a registered FinancialScents Platform member’s Personal Data is protected with a password. When a User’s information is transmitted, FinancialScents uses SSL (Secure Socket Layer) and encrypts information that has been inputted in order to prevent its loss. However, generally speaking data transmissions over the Internet cannot be guaranteed to be 100% secure. FinancialScents does take measures to protect the User’s Personal Data, but cannot guarantee that all information provided to FinancialScents is absolutely secure.

FinancialScents will take steps to prevent the unauthorized access, loss, destruction, unauthorized editing or leaking of Personal Data and in the event of any of the above occurring will take proper corrective measures.

8. Liability

To the fullest extent permissible by law, FinancialScents bears no liability if a third party gains access to Personal Data in the following circumstances:

8.1. If the User has used features or services provided by FinancialScents to reveal or share Personal Data with a third party.
8.2. If the identity of a User has been ascertained based on information that the User has inputted into the FinancialScents Platforms.
8.3. When content containing Personal Data has been uploaded to the site by a third party.
8.4. If an Event Organizer violates any regulations in the handling of personal data.

9. Links to Third Party websites

FinancialScents is not responsible in any way for the security and/or management of Personal Data shared by Users with third party websites accessible via links on the FinancialScents Platforms.

11. Severance

If any provision of this Privacy Policy is determined to be invalid or unenforceable, then such invalidity or unenforceability shall not have any effect on any other provision of this Privacy Policy, which shall remain valid and enforceable.

12. Third Party Rights

A person who is not a party to these Terms and Conditions has no rights under the Contracts (Rights of Third Parties) Act (Chapter 53B of Singapore) to enforce any term of these Terms.

13. Governing Law and Jurisdiction

This Privacy Policy shall be governed and construed in accordance with laws of the Republic of Singapore. Any dispute arising out of or in connection with this Privacy Policy including any question regarding its existence, validity or termination, shall be referred to and finally resolved by the Courts of Singapore.
